Is it ok If I put up 3 mp3s of my favorite band on my website? Is it allowed If I get the bands permission?

Of course, providing the artist has allowed you ;)

What if you haven't talked to the artist yet?

Atomic:

you can not post or distribute any mp3's that you do not own the rights to or have the permission to distribute from the person who does on the right to it.

iow: no, you can't.

The artist's permission is not enough. You need permission of the music's copyright holder as well.

Generally speaking, making any copyrighted material publicly available is a big no-no. The exception, of course, is if you are the copyright holder. That includes sound, video and even images. While it is a common practice on the web to use images gathered from other sources, it is technically copyright infringement if you do not have the copyright holder's permission to use their material.

Let me restate this: will PowWeb care? Like, will I only get in trouble if the "copyright" owner finds out?

Yes, powweb cares. If they find out, you can lose your site.. it's not only against the ToS, it's against the law.

If we find that you intentionally violated our ToS, we will terminate your account.

FYI: Linking to sites that violate our ToS may also result in the suspension or termination of an account.

You don't need to antagonize me. I could be hosting a website for my friend who wants to share mp3s, and I wasnt sure what I should say.

Hi Atomic,

Just be up front with them. Tell them this would violate copyright. Tell them that you no many do it, but it does not make it right. Also let them no that it could result in your site being shut down, then neither would have any web space, you are him.
