Here is a flyer that I am doing for my car club. Any and all comments and suggestions are welcome.

The design looks nice. I like the fonts, colors and the tag line, but I think you need a comma. "It's not just a car, it's a lifestyle." The handwriting font is okay, but maybe another handwriting font is better. Still looks nice.

Did you get permission from the car manufacturer to use the car designs in your design? I just went through a similar situation with slfba.org and General Motors. The car club could not print t-shirts or anything without express written permission from General Motors. We did get permission from GM, so the printers will print the designs.

Don't forget the copyright info on the designs including the copyrights for the car manufacturers. Please be careful with this, since I know other people who got fines and/or jail time for noncompliance with this law. Car manufacturer's own copyrights to their cars' body styles so even drawings are protected.

Good job, it gets the message across in a pleasant way. This is not advice but a very recent court case involving the image of a well know product, the barbe doll, being used commercially and the judgment went to the user rather than the holder of barbe rights. Why, the image of barbe is not a barbe, or some such. Though your flyer cars are not Mercedes they could well be generic Honda's, so what (you could say they are Yettas - I hope Yetta is not an actualy model - if so change it to Yattes) .

Thanks for the feedback.

No.... Yetta is not an actual model. I was not aware that you could not print pictures of your car. Sounds kinda rediculous if you ask me. Technically that means you cant take pictures of your car than??? Probably not really on track there but just being an *** cause I hate the fact that someone can tell me I cant do something (car manufacturers).

lol.... anyway thanks alot. I will probably throw a comma in there. I also think that it could use one now that I read it with one.

Thanks,

Mike

P.S. More comments please!

1st thing.Definately add a comma after car...I'm liking the colors & fonts you've chosed.A background with 2 images of cars..I thibk you could have made the design more cutting-edge but based on your color & font selection I think it'll stand out

Technically that means you can't take pictures of your car then

The Street Lethal F Body Association was unable to print their logo design with the inclusion of a Pontiac and a Firebird. The photos were taken of cars belonging to members of the club. CafePress refused to print and stated the legal reasons. The club asked us to create designs of cars and I warned them of the same problem. The club president was furious.

I contacted General Motors by email. They gave me info for their attorneys. I called them in Michigan and got the correct person to get permission. The attorneys asked for a written request by the car club and they gave written permission.

So you can't take pictures and resell them or include them in a design. Fair use may come into play for a news event, but the club planned on selling t-shirts with their logo which crossed into the licensing laws as well as copyright laws.

Better safe than sorry. Contact the manufacturer before distributing anything.

I can see where if you were making profit off of something when you use someone elses design or copyright. However I dont thinkg that is any kind of infringment when you are not selling them. These are simply flyers. They serve no purpose but to advertise our website. I will let you know if I get in any trouble.... lol

Thanks alot.

JJ, thanks for posting the link. I have other links on my website, because clients will argue with me. The rules are quite different from years ago.

The comment about the grass in the windows - I was so concerned with the copyrights that I forgot to mention that. And I have edited images like that. ;)

The images will be on flyers distributed for an event. If you request permission to use the images for this manner, you may get permission as we did for SLFBA.

I am sure you noticed many people breaking the copyright laws. Some people honestly don't know while others don't care. But regular misuse will get you in real trouble.

I know someone who made wedding videos and used the original music instead of buying royalty free music to edit and include with the video. (I used to produce videos.) This person got 3 years in jail and/or $25,000 fine! A wedding is an event, and even if he was not paid for the video, he distributed the music. It is also illegal to record phone calls or use a video to record audio without permission, no matter who you are recording!

We used to video car shows and had to get permission from the owners of the parking lot, the car club and every owner of every car in the video. Then we would edit royalty free music we purchased for audio that may be included with narration.

I know, a lot of talk about this subject, but it is important.

On that note.Enough of this forum..My NEW girlfriend is in need of attention........(But I do love graphix also...It doesn't talk back) ;)
