I am well aware of what the policy here is regarding adult material, but what i've always wondered is why? The reason this came into my head was because a friend of mine who runs another Web hosting comany (that WILL accept adult material) had asked me. We were also wondering if the bosses here might be willing to possibly refer adult clients to him somehow....

Referring customers to your friend is like saying we don't sell drugs here, but we can refer you to someone else who does! They do not LIKE adult material. If you link to your friends adult hosting site from your PowWeb hosted site, you could be breaking the ToS.
The rules ARE strict here since they don't even allow artistic nudity - pictures of paintings, statues or photos of nudity. But the laws are also strict. They are protecting the customers, themselves and the website visitors when they create and enforce these rules. If you have children, you should understand.
If someone contacts you about an adult website, you can recommend your friend at that time. I have helped a few "not for general audience" websites, but I cannot include them in my portfolio or link to them.
Even if we were NOT talking about adult material, I can't imagine any web host referring clients to ANOTHER web host unless they got compensation of some type.

Wow, I never knew the rules regarding adult content here were THAT strict Mind you I'm not talking about DIRECTLY linking to adult content....I'm talking about linking to another hosting company that will host the stuff...Right now the site I'm talking about is NOT a ToS violator....BUT the new one that is being built is questionable.....
No kids here, but do understand the issues as I do alot of Information Assurance work and have been on adult sites and have seen the problems that they bring first hand. They are a unique animal with the security stuff that comes up...

I'm actually glad I posted this....one of my clients is an entertainment promoter and he will need to be SUPER careful...

The determination of which is left up to PowWeb's discretion.

TOS and AUP are explicitly clear. Porn is not allowed on our servers.
It's in our discretion as to whether or not we want to allow you to link to sites that host port. If it happens, and people complain about it, it's likely we're going to suspend your account.
It all depends on how it's done.
Hosting porn here, however, is completely out of the question.

I'm mainly wondering if Powweb has considered reffering potential clients that do want to host adult material on the server (and are thus denied service) to other hosting companies and IF this has been done what would have to be done to go about being reffered? My first post explains things better.....I needed to talk to Staff to get an answer on this issue :)

No, PowWeb would never do that. We don't allow Porn on our servers, and wouldn't recommend any other service that does.
If someone contacts us asking about it, we simply tell them we don't offer it. We don't point them in another direction.
If you went into McDonald's and asked for a Whopper, would they tell you to go to Burger King? No. They'd just tell you that they don't sell Whoppers.

Actually, my first job (as a teen) was at McDonald's. Some kids would tell customers to go to Burger King. Some would correct the customer and ask them if they want a Big Mac. Others just rang up the Big Mac and didn't bother to explain. Many customers deliberately asked for a Whopper just to get a reaction out of people. At minimum wage, kids really didn't give a hoot.
When they asked ME for a Whopper, I asked if they meant those little chocolate covered malt balls or if they wanted to go fishing. Another guy asked a customer if he wanted to go downstairs to the break room to see HIS whopper! (Yes, he was gay.) In a few months, that job was educational but I had to get another job as my parents witnessed the cloud of smoke from the kids smoking (pot) outside. I tried clicking my heels three times, but it didn't work! ;)

I wouldn't bother adding a link to adult hosting. It can offend some of your clients. Simply recommend adult hosting to clients who ask for it. It's like standing next to someone who smokes. Your clothes get stinky and dirty just for being next to him/her.

I should clarify. Although he has no problem hosting adult sites it won't explicitly say it on his main site

As far as a why regarding porn sites there are a few different reasons why hosts might not want to host porn.
1. Philosophical reasons.
2. Legal Reasons
3. Load/Traffic Reasons
I would guess that number 2 is the biggest reason. From a legal standpoint you have to deal with differnet regulatory agencies having different policies. What might be legal in the US might be illegal in another foreign country. You may also run into issues with sites that haven't carefully verified age of the "models".

Many countries have different ages for what they consider to be an adult. While 14 is acceptable in some countries, you must be 18 in the US. For gambling, you must be 21 here and 18 in Aruba. Instead of trying to keep track of the laws, many web hosts simply avoid these contents altogether. It is much easier.
I don't like linking to other sites that have questionable ethics. You have no control over their contents or links and they are more likely to have inappropriate contents. If not now, then maybe later. Do you want to keep checking to make sure it is acceptable?
Don't pick on smokers. Some of us are nice people.
I know a lot of nice smokers. Look back at my post. I mentioned the kids who smoked pot. That does have a distinct odor and many of us do not condone drugs.

This is what happened to Joe Francis. I'm familar with some of the porn laws. Where he appears to have scrwed up (if you believe his defense) is that he took the models at their word when they filled out their 2257 forms. If I were him i'd be having a PI look at all my 2257 forms to confirm that what was on them was accurate
